Suspend work for late payment (creator policy)

Late payment without a suspension policy turns you into an unpaid staffer. Publish a simple +1 / +7 / +14 / +30 day ladder on your rate card so pausing work is a process, not a panic DM.

This page is not legal, tax, financial, or other professional advice. For a live deal, talk to a lawyer and a tax or finance specialist in your jurisdiction — BlueRateCard is not either.

Suspension and takedown rights depend on your contract and local law. Talk to a lawyer before removing content or alleging breach on a live campaign.

Policy table: +1 / +7 / +14 / +30 days overdue

Clock starts the first calendar day after the invoice due date (Day 0). Put this table (or a shorter version) in your terms so nobody is surprised.

Days overdueYour actionWhat you sendWork status
+1 day (Day 0)Assume process lag, not malicePolite reminder with invoice PDF, due date, balance, payment linkContinue only if already-scheduled posts were prepaid; no new scope
+7 daysFormal hold on remaining deliverablesNotice: remaining Stories/Reels/cutdowns paused until funds clear; CC APSuspend unpublished work; do not start revision rounds that expand scope
+14 daysFormal payment demandDemand letter with cure deadline (often 7 days) + reserved rightsNo new production; licence questions per your terms + lawyer if needed
+30 daysEscalate path you already named in termsFinal notice; may pursue collections/small claims/counsel — lawyer review before court threats if balance > ~$3,000No further production

Some creators use a softer +15-day reminder before the +7 pause on small balances only — if you do, say so in writing on the rate card.

What “suspend” does and does not mean

Does mean

You stop creating or publishing unpaid remaining units. You calendar a restart within a set window (e.g. 5 business days) after cleared funds. You keep records.

Does not mean

A public callout thread, silent ghosting without notice, or inventing new penalties mid-stream. Notice first, then hold.

Grey area

Taking down an already-live post. High legal and relationship risk. Read the licence clause and call a lawyer — especially if ads are running.

Paste-ready policy snippet

  • Invoices are due on the stated calendar date. Day 0 is the first day after that date; a reminder goes out on Day 0 (+1 day overdue).
  • At +7 days overdue, remaining deliverables are suspended until funds clear; we notify the brand and AP in writing.
  • At +14 days overdue, we issue a formal payment demand with a cure deadline.
  • At +30 days overdue, we may pursue collections or other remedies listed in the agreement.
  • Late fees apply only if printed on the agreement/invoice. Suspension does not waive amounts already earned for delivered work.
  • Restart after payment: we resume within 5 business days unless the brief has materially changed (then requote).

Example: $2,200 package, 1 Reel live, 3 Stories left. Due date missed. Day 0 (+1) reminder. Day +7 you pause Stories and say so in one email. Day +14 demand letter for $2,200 (or remaining balance if any partial paid). Day +30 escalate if still open. You did not “flake” — you followed a published ladder. Brands that fund via a platform payment hold never trigger it; that is the point of prepaid rails (creators free, brand fee 5% capped at $100 on BlueRateCard).

Worked hold: $2,200 · Reel live · 3 Stories left

+30Final notice + named next step$2,200Collections/small claims/counsel path

Certified mail optional above ~$2,500. Put your ladder on the rate card before the fight.

Multi-phase campaigns

If phase 1 is unpaid, do not start phase 2 because “the campaign needs momentum.” Momentum is their marketing problem; cash is yours. Tie each phase to a funding event in the SOW. A $1,000 phase-1 Reel should not unlock a $4,000 phase-2 series on vibes.

Write the ladder once. Enforce it the same way for friendly brands and cold ones. Consistency is what makes suspension look like policy instead of spite — and what makes the next brand accept a platform payment hold without a debate.

Late-payment suspension questions

+How do I run +1/+7/+14/+30 on a $2,200 package with Stories left?

Reel already live for $2,200 unpaid: +1 polite reminder (first day after due). +7 pause the 3 remaining Stories in writing (CC AP). +14 formal demand for the full $2,200 (or remaining balance). +30 name collections/small-claims/counsel if still open. Restart within 5 business days of cleared funds — do not keep posting “to keep the campaign warm.”

+When should I pause posting if an invoice is overdue?

If more deliverables remain (extra Stories, a second Reel, a cutdown), pause new work at +7 days overdue after a written reminder at +1 — sooner on very large balances if your terms say so. Do not keep shipping free inventory while AP “looks into it.”

+Can I take content down for non-payment?

Only if your contract preserves that right or a lawyer says your licence allows it. Blind takedowns can create separate disputes. Prefer suspending unpublished work and escalating payment first; get counsel before deleting live posts on a contested deal.

+What do I tell the brand at day +7 of late payment?

A short factual note: invoice number, days overdue, balance, that remaining deliverables are on hold until cleared funds, and that a formal demand follows at +14 if unpaid. Copy AP. No essays.

+Does suspending work void my right to the unpaid fee?

It should not — you are stopping further performance on a breached payment schedule, not gifting them the work already delivered. Keep the clause and the timeline in writing. Ask a lawyer if they claim you “abandoned” the campaign.

+Should kill fees still apply if I suspend mid-campaign?

If they cancel because they will not pay, kill-fee language may still matter. If you suspend per a written late-payment policy they accepted, document that you remain ready to finish within X days of cleared funds. Counsel helps when numbers are large.
