Brand didn't pay? Creator recovery timeline

A brand that ghosts an invoice is not a “slow AP week” until you treat it like one with dates. Run a Day 0 → Day 60 recovery clock: remind, escalate, pause work, demand, then decide on collection. Politeness without a calendar is how $2,400 becomes a write-off.

This page is not legal, tax, financial, or other professional advice. For a live deal, talk to a lawyer and a tax or finance specialist in your jurisdiction — BlueRateCard is not either.

This guide is practical recovery hygiene, not legal or tax advice. For disputes above a few thousand dollars, or if ads are still running on unpaid assets, talk to a lawyer before you threaten court or revoke licences.

Day 0 → 60 recovery timeline

Treat the due date as a hard line. If the invoice was $1,200 Net 30 and today is day one past due, you are already on Day 0 — not “giving them another week because the marketer is on holiday.” Holiday is their problem; your rent is not.

DayYour moveChannelOutcome you want

Day +7Pause remaining deliverables in writing; cite late-fee clause if anyEmail with “READ / action required” subjectWork stopped on unpaid SKUs; clock still running

Day +30Final notice; reserve rights; consider usage suspension noticeEmail + optional certified mail if amount > ~$2,500Decision path: settle, mediate, or counsel

Example: $1,800 Reel, due 1 Aug. Day 0 = 2 Aug. Day +14 demand = 16 Aug. Day +60 = 1 Oct. Do not invent new deliverables in that window.

What “they didn’t pay” usually means

Most unpaid creator invoices are not sophisticated fraud. They are a junior marketer who never raised the PO, an agency waiting on their client, or a brand that used your Reel in paid while AP sat on a $900 line because nobody owns freelancers. Your job on Day 0–7 is to find the human who can release funds — not to send seven soft “just checking in” notes to the same dead inbox.

Separate cash risk from reputation risk. If the post already went live and they are running Spark or Partnership Ads, unpaid use is a second injury. Log the ad activity on Day +3. A brand that will not pay a $1,500 content fee but will spend $4,000 on media behind your handle has budget — they chose not to route it to you.

PO never raised

Ask for the PO number in every chase. No PO after Day +7 means you stop future SKUs and escalate to whoever signed the brief.

Agency float

“We pay when the client pays” is not your term. Demand the brand fund you directly or via a platform payment hold; keep the agency on CC for proof.

Quiet dispute

If they suddenly say “quality issues” on Day +10 with no prior notes, treat it as a stall. Point to written acceptance or the revision window they skipped.

Numbers that keep you honest

A $600 Story sequence is not worth a $400 lawyer letter on Day +14 — but it is worth pausing the next package and marking the brand as prepaid-only forever. A $4,500 dedicated YouTube integration overdue 30 days is worth a formal demand and a call with counsel before Day +60. Write those thresholds for yourself now: under $1,000 = timeline + stop work; $1,000–$3,000 = demand letter; above $3,000 = lawyer review before you threaten filings. Adjust for your market; do not improvise under stress.

If you waived a 50% deposit “to be easy,” you financed their campaign. Next deal: a platform payment hold or deposit before the shoot. Recovery is expensive; prevention is a checkout hold. Creators who recover one late $2,000 invoice and then keep accepting Net 60 on vibes will repeat this calendar until they burn out.

  • Never delete the original invoice — issue a statement of account if you add late fees.
  • CC yourself on every chase so the thread is one searchable chain.
  • Do not trade a partial “goodwill” Story for a promise to pay the balance next month.
  • If they offer 50% now and 50% “after the campaign report,” take the 50% and put the rest on a new due date in writing — or decline.
  • Ask a tax specialist how to treat a true write-off; do not invent deductions from a Instagram DM.

Name the payor before Day +14

Competitors and court clerks care about the registered company, not the cute brand handle. By Day +7 you should know who can actually release funds. Wrong defendant on a later demand wastes the cure window.

Ads still spending on your assetBudget exists; AP chose not to route itScreenshot Ad Manager / Spark on Day +3; attach to formal notice.

Example: @GlowLab posts your Reel, but the PO says Glow Lab Commerce LLC. Put the LLC on INV and on the formal notice — not only @GlowLab.

State business-entity search pages and the address on their privacy policy often reveal the LLC faster than another “just checking in” DM. You are building a file, not a friendship. Pair this table with the overdue email templates when you need paste-ready copy for Day 0 / +7 / +14.

Day +7 pause email (copy-paste)

Soft reminders without a pause teach the brand that content still ships on credit. Send this once — then stop unpaid deliverables.

Subject: Action required — INV-____ ($____) overdue · remaining work paused

Hi [Name] — copying AP / finance if I have the alias.

Invoice INV-____ for $____ was due [date] and remains unpaid.
Per our agreement, I'm pausing remaining deliverables (Stories / extras / next SKU)
until the balance clears or funds sit in a payment hold.

Please confirm in writing: (1) legal payor entity, (2) payment date this week,
(3) wire/ACH confirmation.

Happy to resume the moment it's funded.

After Day 60

Some invoices never clear. Document the loss, stop all unpaid usage you can control, and blacklist the domain on your rate card process. Do not spend another unpaid weekend “building the relationship.” Relationships that require you to work for free are procurement, not partnership. The timeline above exists so you decide with dates instead of hope — and so the next brand funds a platform payment hold on day one, not a recovery spreadsheet on day sixty.

Payment & recovery

Unpaid brand deal questions

+What if they send a partial payment and ask me to keep posting?

Take the partial only if you write a new due date for the balance and pause unpaid SKUs until that date. Do not ship the next Story “as goodwill.” Partial cash without a written remainder schedule is how $900 leftovers become permanent write-offs.

+When does the Day 0 clock start on a missing payment?

Day 0 is the first calendar day after the due date on the invoice or SOW — not the day you posted, and not the day you “felt” it was late. If the deal said Net 30 from invoice date and you invoiced on the 1st, Day 0 is the 31st (or next business day if that is how you wrote the terms).

+Should I keep posting for the brand while chasing the invoice?

No. A second Story or a “bonus” Reel while $1,800 sits unpaid trains them that content still ships on credit. Pause remaining deliverables in writing on Day 7 at latest, and do not start any new SKU until the balance clears or sits in a payment hold.

+Should I hire a collections agency before I talk to a lawyer?

Usually no on first-time unpaid deals under a few thousand dollars — collections takes a cut and can sour a fixable AP delay. Finish the day-14 demand and pause new work first. Collections fits when the brand looks solvent, your paper trail is clean, and you would rather sell the claim than appear in court. Ask a lawyer before you assign anything.

+Can I reclaim usage rights if they never paid?

Only if your contract or licence says payment is a condition of the grant. Many vague “usage included” emails do not auto-revoke. Write a short notice that paid rights are suspended until the invoice clears, and have a lawyer review if the brand is still running ads.

+What evidence should I gather before day 14?

Signed brief or email acceptance, rate quote, invoice PDF with due date, delivery proof (post URL, file transfer receipt), every chase email with timestamps, and any “we’ll pay Friday” promises. Screenshot Ad Manager or Spark activity if they are running your asset unpaid.

+What if the Instagram handle is not the company that owes me?

Chase the legal entity on the PO, W-9 request, wire instructions, or Secretary of State filing — not the @handle. Put that LLC or Inc. name on the day-14 notice. If an agency signed the SOW, keep both agency and brand on every escalation email until one of them funds you.

+What does a $1,800 unpaid Reel recovery look like in practice?

Day 0–3 soft chase to AP + marketer. Day 7 pause remaining work in writing. Day 14 formal notice to the LLC on the PO with evidence pack. Day 30–60 decide small-claims / lawyer / write-off. Do not add a free Story on Day 5 “to keep them warm.”
