Organic vs paid usage rights

Organic means the post lives where people choose to see it. Paid means someone bought the impression. Brands collapse those because the file looks the same. Your quote should not. Use a yes/no grant list, then price the paid column.

This page is not legal advice and is not a substitute for a lawyer. Have an attorney in your jurisdiction review any contract, licence, or rights grant before you sign.

Ad products — same word, different SKUs

Briefs say “boost” for everything. On this site these are separate lines. Meta’s UI label Allow brand partner to boost means Partnership Ads permission — not the Instagram Boost button.

SKU (say this)Who the ad looks likeWho spendsWhat you grant
Brand-account ads (paid usage / dark post)The brandTheir ad accountFile + licence (days, territory, spend) — no Partnership permission
Creator BoostYour organic post, boostedYour Meta ad account (they prepay media)You tap Boost; set budget + duration — never share your password
Partnership Ads / whitelistYou (usually with the brand in the header)Their Ads ManagerInstagram: partnership ad code or Allow brand partner to boost (= Partnership permission)
TikTok Spark AdsYour TikTok videoTheir TikTok Ads accountAd authorization code (7 / 30 / 60 / 365 days)

If they say “boost included,” ask who spends and who taps Boost — then pick one row.

Grant list (tick what they bought)

Send this table with Y/N filled in. If a row is N, they cannot do it “because they already have the file”.

Never sell “organic includes paid amplification”. The grant list above is the contract spine; this table is the invoice.

Certifying paid usage vs “ads as you” (YouTube & X too)

Paid usage (ads as them): you usually only need a written licence + file delivery. No Instagram Partnership toggle, no Spark code. Ads as you: platform permission (Partnership / Spark / YT brand partner access). Disclosure (“paid promotion”) on the organic video is not the same as selling a media licence.

PlatformPaid usage — your tapsAds-as-you — your taps
Meta / InstagramDeliver file; invoice “brand ad accounts”; no partner invitePartnership ad code or Allow brand partner to boost (= Partnership Ads permission, not the Instagram Boost button) — see whitelisting guide
TikTokLicence the file for their non-Spark ads if soldAd settings → authorization → code — see Spark fee guide
YouTubeLicence + optional Studio “paid promotion” check if the video is sponsoredShare brand partner access so they can promote via Creator Partnerships / boost tools
XLicence creative for Promoted posts from the brand’s ads accountNo Meta-style whitelist for most creators — sell days/territory in the licence, not a mystery toggle

Term + territory (write it on the invoice)

“Paid usage” without days and countries is an open cheque. Fill every paid cell with both. Organic can stay “named channels, creator-posted” — paid cannot.

Controlling media budgets on paid usage (and whitelist)

Limiting “marketing budgets” is a contract + Ads Manager job. You cannot see their campaigns for pure paid usage, so the enforceable pieces are: a written max spend, named countries, and renewal/overage fees if they exceed. Whitelist adds a revoke lever because the ads run as you.

Meta spending-limit how-tos: how much to charge for whitelisting. Creator Boost steps: Partnership Ads vs boost.

DM when they say “just boost the organic”

Organic fee = I post on my channels (+ unpaid reshare with credit if we sold that).

Brand-account ads or Creator Boost is a separate line: term + territory + who pays.
Happy to add 30-day Brand-account ads (paid usage) at +__% of the content fee, or a capped Creator Boost line.

Whitelist / ads as my handle is a third product — not included in paid usage or Creator Boost.

Sentences that survive a legal pass

Organic default

“Fee covers creator-posted content on the named channels for 12 months. Brand may organically reshare with credit. No paid media, no owned-media placement, no partner ads.”

Paid add-on

“Paid usage: brand may run the approved asset as a paid ad from brand-owned ad accounts, [platforms], [territory], for [N] days from first impression. No creator-handle ads.”

Blur killer

“Brand-account ads, Creator Boost, Spark Ads, Partnership Ads, and whitelisting are paid media even if the caption is unchanged.”

If they already ran the ad

  • Screenshot the ad library / Spark dashboard with date.
  • Invoice the paid-usage cell at the 90-day rate as a minimum, even if they “only tested for a week”.
  • Revoke any leftover partner access.
  • Do not start the next deliverable until that invoice clears, sits in a payment hold, or is paid.

Most “we thought organic included boosts” emails are real confusion, not theft. The grant list fixes it before the shoot. After the fact, you still bill the cell.

Why “it’s the same file” is the trap

Organic rights are about distribution you already sold: your grid, maybe their unpaid reshare. Paid rights are about buying other people’s attention with your face. The file can be identical. The product is not. If a brand’s lawyer says “we already have the asset so ads are implied”, they are describing a buyout they did not pay for. Point at the N in the Brand-account ads row and invoice that row.

Website and email sit in a grey zone because they feel “not ads”. They are still owned media that can run for years under a blog post. If you want to be generous, give 90 days on the brand’s site with a nofollow credit. If they need it in a welcome series forever, that is a dated licence or a buyout cell, not organic.

Usage rights & licensing

Organic vs paid rights questions

+Does organic-only include Brand-account ads or Creator Boost on the same post “just for a few days”?

No. Paid spend behind the post is paid media — Brand-account ads (their ad account) or Creator Boost (you tap Boost). Organic-only covers you posting and (if sold) unpaid reshare with credit. Write “no paid amplification” on the organic row, then sell a dated paid-usage or Creator Boost line if they want spend.

+What can a brand do with organic rights only?

Usually: you post on your channels, they may reshare to their organic social with credit, and they may use a still in an unpaid internal presentation. Not ads, not email, not packaging, not your Ads Manager.

+Does “paid usage” include Brand-account ads from their own ad account?

Yes — Brand-account ads (paid usage / dark post) is the core of that line. It still needs a term and territory. It is cheaper than whitelisting because the ad is not from your handle. Creator Boost is a separate SKU (you tap Boost; they prepay media).

+If they already screenshotted my post, is that paid use?

The screenshot existing is not the violation. Putting it into Ads Manager, a landing page, or a paid social post is. Organic rights should say “no paid media” in those words.

+Can organic rights include their website and email?

Only if you sell that cell. Website and email are owned media with a long shelf life. Treat them as paid-adjacent: 90-day web use is a line, not a free extra on a Reel.

+How do I write the two permissions so they cannot blur?

Two headings, two yes/no lists, one sentence: “Paid media is not organic even if the creative is the same file.” Attach it under the fee.

+How much extra is 90-day paid usage vs organic-only on a $700 post?

Organic stays $700. Paid social from their accounts ~+40–60% = $280–$420. Whitelist from your handle is another product — see the pricing matrix, do not fold it into “paid”.
